BOSTON - Citing a possible gap in state law, a state Appeals Court judge on Friday threw out the conviction of a homeless sex offender in Greenfield for failing to notify authorities that he moved to a new residence. Claude Bolling, a "Level 3" sex offender - meaning he is considered by the state to be at high risk of re-offending - registered his permanent address as "the streets of Greenfield" to comply with the state's sex offender registration laws. He also listed a postal box in neighboring Montague as a mailing address. Under the law, sex offenders must provide police or the state at least 10 days notice of any change in residence.

Kory Emge, 22, was convicted last year of child exploitation, a Level 5 felony. He is now charged with failure to register as a sex offender after moving to a campground without reporting his address change so his listing on the sex-offender registry could be updated, court documents state. Emge failed to register a change of address twice in recent months, officials said. In April, he failed to tell county officials he had moved to the Greenfield Inn, records show. Sex offenders must report address changes within 72 hours in Indiana, according to court records.
